In compliance with the provisions of the Federal Law on the Protection of Personal Data held by Private Parties, we present this Privacy Notice, which aims to inform you about how «KOM» will process your personal data and/or sensitive information provided, and inform you of the following:

The personal data we collect from you will be used for the following purposes:

CLIENTS AND SUPPLIERS:

To fulfill the legal relationship arising from the requested service, in accordance with the contractual relationships that may be created, to propose, process, issue, investigate, verify, cross-check, validate, and corroborate data for making proposals, quotations, offers, and, in general, to exercise any contractual right or obligation.

GENERAL PUBLIC:

To provide security and protection to individuals working at or visiting KOM’s offices, as well as to its movable and immovable property.

HUMAN RESOURCES:

To request, receive, validate, verify, and follow up on job proposals; to conduct personnel selection processes; to verify job, professional, and academic references; to evaluate profiles, abilities, skills, and knowledge; to carry out training processes; to record attendance or entry and exit from KOM’s facilities; for the payment of employee benefits; and, in general, to fulfill the rights and obligations arising from employment relationships, both during and after employment.

CONSENT OF THE DATA SUBJECT:

The data subject acknowledges that this Privacy Notice has been made known to them by «KOM,» and they grant their consent for the processing of their personal data in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties and other applicable regulations.

If, after 15 days from the availability of this Privacy Notice, the data subject does not object to the terms outlined, it will be considered that they have granted their consent for the processing of their personal data.

COLLECTION OF PERSONAL DATA:

«KOM» collects personal data directly from the data subject or through a person designated by «KOM.» Alternatively, it may collect data from publicly accessible sources and other available sources to which the data subject may have consented to share their personal information.

USES AND PURPOSES OF YOUR PERSONAL DATA:

The personal data you provide to «KOM» will be handled confidentially and with discretion to fulfill obligations arising from the relationship that may exist with the data subject.

If your personal data is intended to be used for a purpose different from the one specified, «KOM» will notify you by email or phone to obtain your consent for the processing of your personal data for the new purposes. If consent is not received, «KOM» will not use your personal data for those new purposes.

TRANSMISSION AND TRANSFER OF PERSONAL DATA:

«KOM» will not share your personal data with third parties, whether domestic or foreign, without your prior consent, unless required by law or a judicial mandate, or if the information needs to be shared with «KOM» contractors to carry out necessary operations for «KOM» and to fulfill the purposes outlined to protect the rights or assets of its clients. This transfer must comply with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties. We have required our contractors to agree to use your personal data solely for the purpose of carrying out the operations for which they were hired.

SECURITY:

«KOM» has implemented the necessary administrative, technical, and physical security measures to protect your personal data from damage, loss, alteration, destruction, or unauthorized use, access, or processing. However, «KOM» cannot guarantee that unauthorized access to your personal data will never occur or that communications will be free from interruption, errors, or interception by unauthorized third parties.

Access to your personal data held by «KOM» will be limited to individuals who need to access this information to carry out the identified purposes.

ARCO RIGHTS (ACCESS, RECTIFICATION, CANCELLATION, AND OPPOSITION):

As the data subject, or through your representative, you have the right to exercise your ARCO rights (Access, Rectification, Cancellation, and Opposition). You have the right to access the data we hold, correct any inaccuracies or incompleteness, cancel them if you believe they are no longer necessary for the purposes stated in this Privacy Notice, and object to their processing for specific purposes.

The data subject or their representative can submit a request to exercise any of the ARCO rights by sending it to the email address contacto@komco.mx or by delivering it directly to our offices at the address indicated, addressed to our Personal Data Department.

To address your request, it must include the data subject’s name, address and/or email address for communication of the response, documents proving the identity of the data subject or, if applicable, their legal representation (a simple copy in printed or electronic format of the authorization letter signed by the data subject and their representative, along with the corresponding official ID), a clear and precise description of the personal data regarding which any of the rights mentioned are to be exercised, and any other element or document that may assist in locating your personal data.

«KOM» will inform the data subject of its determination within a maximum of 20 business days from the date the access, rectification, cancellation, or opposition request is received, so that, if applicable, the request will be implemented within 15 days following the notification to the data subject.

For access requests to personal data, the responsible party will proceed with delivery upon verification of the identity of the requester or their legal representative, as applicable.

For cancellation requests, in addition to the provisions of this Privacy Notice, the data subject must refer to Article 26 of the Federal Law on the Protection of Personal Data Held by Private Parties, including cases of exceptions to the cancellation of personal data as specified therein.

CHANGES TO THE PRIVACY NOTICE:

«KOM» reserves the right to modify this Privacy Notice. If this happens, we will notify you through the publication of the updated notice on the website http://www.kom.com.mx. «KOM» will understand that if no objection is expressed, it means that the data subject has read, understood, and agreed to the terms presented, constituting their consent to the changes made regarding the processing of their personal data in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties and other applicable legislation.
